Official Minutes SM Town Council Meeting

The Town Council of the Town of Signal Mountain held its regular monthly meeting on Monday, January 13, 2003, at 7:00 p.m. in the Town Hall. Those present were:

Mayor James H. Althaus, Vice-Mayor William O. Leonard, Councilmember Rachel Bryant, Councilmember Stephen Ruffin, Councilmember Robert E. White, II.

Also present were:
Town Manager Hershel Dick, Town Recorder Diana Campbell, Town Attorney Phil Noblett.

The Mayor called the meeting to order. Councilmember Bryant offered the prayer. The Town Recorder called the roll.

The Council considered the minutes of the December 9, 2002, regular monthly meeting and the December 30, 2002, special called meeting. Mayor Althaus made a motion to approve the minutes. Councilmember Ruffin seconded the motion and it passed unanimously.

The first item before the Council was an ordinance for second and final reading titled “AN ORDINANCE AMENDING TITLE VIII OF THE SIGNAL MOUNTIN TOWN CODE REGARDING ALCOHOLIC BEVERAGES, TO INCLUDE A NEW SECTION 8-136, AUTHORIZING THE TOWN OF SIGNAL MOUNTAIN TO LEVY AND COLLECT PRIVILEGE TAXES ON ESTABLISHMENTS ENGAGING IN THE BUSINESS OF SELLING ALCOHOLIC BEVERAGES FOR CONSUMPTION ON THE PREMISES IN ACCORDANCE WITH T.C.A. § 57-4-301.” Attorney Noblett explained that this ordinance would allow the Town to collect a privilege tax equal to the amount collected by the State for the on-premises consumption of wine and alcohol. He explained that the privilege tax based on seating capacity of 75 to 125 seats would be $600 for alcohol consumption and the wine only tax would be 1/5 of that or $120. After a brief discussion, Councilmember Bryant made a motion to approve the ordinance. Councilmembe Ruffin seconded the motion and it passed unanimously.

The next item before the Council was another ordinance for second and final reading titled “AN ORDINANCE ADOPTED PURSUANT TO TENNESSEE CODE ANNOTATED § 6-19-101 FOR THE PURPOSE OF AMENDING THE TOWN OF SIGNAL MOUNTAIN, TENNESSEE, MUNICIPAL CODE REGULATING DEVELOPMENT WITHIN THE CORPORATE LIMITS OF SIGNAL MOUNTAIN, TENNESSEE, TO MINIMIZE DANGER TO LIFE AND PROPERTY DUE TO

FLOODING AND TO ESTABLISH ELIGIBILITY FOR PARTICIPATION IN THE NATIONAL FLOOD INSURANCE PROGRAM.” Attorney Noblett briefly explained that MTAS prepared the ordinance and recommended that the Town pass it. The Mayor made a motion to approve the ordinance. Councilmember Ruffin seconded the motion. There was a brief discussion and it was noted that only about ten homes would be affected. The Mayor pointed out that without the ordinance those ten homes would not be able to obtain flood insurance. The Council passed the ordinance unanimously.

Lou Oliphant passed out minutes of the January 9, 2003, Planning Commission meeting and the 2002 Annual Report. She reported that the Planning Commission had an election of officers. She reported that Dan Saieed was elected Chairman, Hale Hamilton was elected Vice-Chairman, and that she was elected Secretary again. She informed the Council that the Planning Commission would be required to obtain four hours of education and training during the year. She further explained the Planning Commission would hold various sessions during the year to comply with the requirement with the help of the Tennessee Local Planning Office.

Each Councilmember made comments or asked questions on various topics of Town business but no further action was taken.
