Town of Signal Mountain Official Minutes of October 8, 2001

The Town Council of the Town of Signal Mountain held its regular monthly meeting on Monday, October 8, 2001, at 7:00 p.m. in the Town Hall.
Those present were:
Mayor James H. Althaus
Vice-Mayor Robert E. Steel, Jr.
Councilmember Rachel Bryant
Councilmember Stephen Ruffin
Councilmember William C. Steele, Jr.
Also present were:
Town Manager Hershel Dick
Town Recorder Diana Campbell
Town Attorney Joe Wagner
Advisory Attorney Phil Noblett

The Mayor called the meeting to order and offered the prayer. The Town Recorder called the roll.

The Mayor congratulated Pat St. Charles, III, for receiving a Distinguished Service Award from Baylor School. He also congratulated Vice-Mayor Robert E. Steel, Jr., for being honored by McCallie School as a Distinguished Alumni.

Councilmember Ruffin made a motion to approve the minutes of the September 10, 2001, special called meeting. The motion was seconded by Vice-Mayor Steel and passed unanimously.

The Ordinances were deferred until later in the meeting.

Next Robert White and Erin Grist addressed the Council and spoke on the completion of the Signal Mountain Historical District nomination. They explained that the area was officially an Historic District. They stated they would make available materials and a map for display in the Signal Mountain Town Library.


The next item addressed by the Council was an ordinance titled “AN ORDINANCE TO AMEND SIGNAL MOUNTAIN ORDINANCE 8-107, TO DELETE ANY PROHIBITION FOR ON-PREMISE CONSUMPTION OF ALCOHOLIC BEVERAGES AND TO RENUMBER THE CURRENT SECTION 8-108 AS SECTION 8-107, AND TO CREATE NEW SECTIONS 8-108 THROUGH 8-135, WHICH SHALL PROVIDE FOR BROWN BAGGING PERMITS FOR ON-PREMISE CONSUMPTION OF ALCOHOLIC BEVERAGES WITHIN THE TOWN OF SIGNAL MOUNTAIN; AND TO INSERT A NEW SECTION 8-209 THROUGH 8-255 REGARDING ON-PREMISE AND OFF-PREMISE CONSUMPTION OF BEER WITHIN THE TOWN OF SIGNAL MOUNTAIN, AND TO DELETE SECTION 8-203 WHICH PROHIBITS THE SALE OF BEER FOR ON-PREMISE CONSUMPTION IN THE TOWN OF SIGNAL MOUNTAIN. Attorney Phil Noblett explained that he had made amendments at the Council’s request. The Section 8-214-B, was amended to prohibit anyone from loitering about the place of business after the hours of operation and not just those individuals under the age of twenty-one, and Section 8-255 was amended to prohibit outdoor advertising. Vice-Mayor Steel made a motion to approve the ordinance. Councilmember Ruffin seconded the motion. The Mayor gave the citizens an opportunity to speak regarding the Ordinance. No one addressed the Council. After a brief discussion by the Council, the Council voted 3 to 2 to approve the ordinance with Councilmember Steele and Councilmember Bryant opposing.

The next ordinance before the Council was an ordinance titled “AN ORDINANCE ESTABLISHING A CURFEW FOR MINORS BELOW THE AGE OF EIGHTEEN YEARS; PROVIDING FOR VALID EXCEPTIONS TO THE OPERATION OF THE CURFEW; AND ENFORCEMENT WHEN A CHILD IS IN VIOLATION.” Town Manager Dick explained that the Public Safety Director, Larry Eddings, had requested this ordinance to establish a curfew for minors. He explained that most cities and counties around the area have already adopted this state ordinance. Vice-Mayor Steel made a motion to approve the ordinance on the First Reading. Councilmember Ruffin seconded the motion and it passed unanimously.

Lou Oliphant gave a report of the Planning Commission’s meeting that had taken place on October 4, 2001.

Under the item for consideration of bids, Town Manager Dick explained that there had been a bid opening for the re-roofing of the Mountain Arts Community Center. He stated that the bids, which ranged from $18,000 to $24,000, were all rejected and the project would be bid again on October 10, 2001. He requested the Council plan a meeting after the 10th to consider the bids. A meeting was planned for 5:30 p.m. on Thursday, October 11, 2001.

The meeting was adjourned.


The Town Council of the Town of Signal Mountain held a Special Called Meeting on Thursday, October 11, 2001, at 5:30 p.m. in the Town Hall.

Councilmember Rachel Bryant
Councilmember William C. Steele, Jr.

Also present:
Hershel Dick, Town Manager

The Mayor opened the meeting and asked for a presentation of the re-roofing rebid for the Mountain Arts Community Center. Councilmember Steele moved that the low bid from J. D. Helton, in the amount of $19,430, be approved. The motion was seconded by Vice-Mayor Steel and passed unanimously.

In other business, the Mayor had been contacted by David Fowler to set up an informational meeting on October 29, 2001, at 7:00 p.m. in the Town Hall. Notification will be handled by David Fowler’s office. This will be an informative meeting, and the Town will not have to post notices.

There being no further business, the meeting was adjourned.
